§ 1

Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

Website – the website available at spinfactory.eu together with all its subpages
User – any natural or legal person using the Website
Client – a User who has placed or intends to place an order for the Service Provider's products
Products – medals, trophies, pins and keychains made to order by the Service Provider
Contact form – a tool available on the Website for sending an enquiry to the Service Provider
GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016

§ 2

General provisions

These Terms and Conditions set out the rules for using the spinfactory.eu website and the conditions for ordering products from PPHU „SPIN" Konrad Kiersztyn.

Using the Website constitutes acceptance of these Terms and Conditions. If you do not agree with the Terms and Conditions, please do not use the Website.

The Service Provider reserves the right to amend the Terms and Conditions. Users will be informed of any change by an update of the Terms and Conditions on the Website.

§ 3

Scope of website services

The spinfactory.eu website provides Users with:

Information about the offer – medals, trophies, pins and keychains made to order since 1981
A contact form for sending an enquiry or requesting a free quote
A presentation of the portfolio of completed projects
Contact details and information about the company

Access to the Website is free of charge and does not require registering an account.

§ 4

Rules for using the website

The User undertakes to use the Website in accordance with applicable law, these Terms and Conditions and good practice.

In particular, it is prohibited to:

Send unlawful or offensive content, or content infringing the rights of third parties, via the forms
Take actions that could disrupt the proper functioning of the Website
Copy and distribute the content of the Website without the written consent of the Service Provider
Impersonate other persons or companies when submitting enquiries
Send spam or unsolicited commercial communications via the Website

§ 5

Order fulfilment

The detailed terms of each order (scope, quantity, graphic design, deadline, remuneration) are agreed individually between the Service Provider and the Client.

Submitting an enquiry via the contact form does not constitute the conclusion of a contract. A contract is concluded only once both parties have confirmed the terms of the order in writing (including by e-mail).

Minimum order quantity – usually from 25 pieces, depending on the type of product and technology; contact us for an individual quote
Lead time – usually from 24 hours to 7 working days from approval of the graphic design; for large orders the time may be longer
Graphic design – the Client may send their own design (AI, EPS, PDF, CDR) or use the free help of a Spinfactory graphic designer
Response to enquiries – we aim to reply to all enquiries within 24 working hours

The Service Provider makes every effort to ensure that the products are consistent with the graphic designs approved by the Client and with their quality expectations.

§ 6

Payments and remuneration

The financial terms of each order are set out in an individual contract or in an order confirmed by both parties.

Payments are made on the basis of a VAT invoice issued by the Service Provider
The payment term is 14 days from the invoice date, unless the parties have agreed otherwise
The Service Provider may require a deposit before starting production – the amount of the deposit is agreed individually
In the event of late payment, the Service Provider is entitled to charge statutory interest for late payment

Prices given on the Website are indicative. The final quote is determined after analysing the Client's individual needs, in particular the type of product, quantity and the chosen production technology.

§ 7

Complaints

The Client has the right to file a complaint in connection with the ordered products.

Complaints should be sent by e-mail to [email protected] or by post to the Service Provider's registered office. A complaint should include:

The Client's full name or company name
The order number and date
A description of the subject of the complaint and the circumstances in which it arose (preferably with photos)
The Client's request together with a justification

The Service Provider will consider the complaint within 14 working days of receipt and inform the Client of the outcome by e-mail.

§ 8

Liability

The Service Provider makes every effort to ensure that the information published on the Website is up to date and reliable, but does not guarantee its completeness or timeliness at all times.

The Service Provider is not liable for:

Interruptions in access to the Website caused by technical factors or events beyond the Service Provider's control
Decisions made by the User on the basis of information published on the Website
Content submitted by Users in contact forms
The consequences of using the Website in breach of the Terms and Conditions

The Service Provider's liability for non-performance or improper performance of an order is limited to the value of the order, unless the damage was caused intentionally by the Service Provider.

§ 9

Intellectual property

All content published on the Website – including texts, graphics, photos, logos, the graphic design and the source code – is the property of the Service Provider or of entities that have granted a licence, and is protected by copyright law.

Without the prior written consent of the Service Provider, it is prohibited to:

Copy, reproduce and distribute the content of the Website in whole or in part
Use the Spinfactory logo, name or visual identity in any way
Modify the content of the Website or create derivative works based on it

Once an order has been completed and paid for, the Client acquires the proprietary copyrights or a licence to the graphic designs produced – the scope of the rights is set out in the contract or the order confirmation.

§ 10

Personal data and privacy

The controller of the personal data of Users and Clients is PPHU „SPIN" Konrad Kiersztyn, with its registered office at ul. Okólna 8/10, 95-020 Janówka, Andrespol municipality, Poland, Tax ID (NIP): 7262375638.

Detailed information on the processing of personal data, including the purposes, legal bases, retention period and your rights, is contained in the Privacy Policy, which forms an integral part of these Terms and Conditions.

By using the contact form, the User consents to the processing of their personal data in order to reply to the enquiry submitted, in accordance with the Privacy Policy.

§ 11

Changes to the Terms and Conditions

The Service Provider reserves the right to amend these Terms and Conditions in the event of:

Changes in the law affecting the content of the Terms and Conditions
Expansion or modification of the scope of services and products provided
Technical changes to the functioning of the Website
The need to adapt the Terms and Conditions to decisions of supervisory authorities or courts

Changes take effect on the date of their publication on the Website. Continued use of the Website after the changes have been introduced constitutes their acceptance.

§ 12

Final provisions

In matters not regulated by these Terms and Conditions, the provisions of Polish law apply, in particular the Civil Code, the Act on the Provision of Electronic Services and the GDPR.

The parties will try to resolve any disputes arising from the use of the Website or the fulfilment of orders amicably. If no agreement is reached, disputes will be settled by the court having jurisdiction over the Service Provider's registered office.

If any provision of these Terms and Conditions proves to be invalid or ineffective, the remaining provisions remain in force.

These Terms and Conditions apply from 29 May 2026.
